Asylum Seekers and Due Process

People from any country may seek asylum in the United States if they feel their lives are in danger in their home country. People seeking asylum must apply within a year of arriving, and they have the right to a trial. Individuals seeking asylum aren’t citizens, but they are people and are therefore granted rights under the Constitution. Those who do not arrive at an authorized port of entry may be subject to expedited removal, but they still are allowed a trial. A backlog in the immigration court system has left many asylum seekers in limbo, however. In 2018, around 690,000 people were awaiting their hearings in immigration court.8 By May 2019, pending cases had approached 1 million.9
